Penelitian ini menganalisis unsur kelalaian dalam tindak pidana penggelapan berdasarkan Putusan Pengadilan Negeri Tanjung Karang Nomor 762/Pid.B/2025/PN Tjk. Tujuan penelitian ini adalah untuk mengetahui apakah kelalaian dapat memenuhi unsur-unsur penggelapan berdasarkan Pasal 372 KUHP. Penelitian ini menggunakan metode yuridis normatif dengan studi kasus putusan pengadilan. Metode yang digunakan adalah yuridis normatif melalui studi kasus dan analisis putusan pengadilan. Hasil penelitian menunjukkan bahwa penggelapan membutuhkan niat dan itikad buruk dalam penguasaan barang secara melawan hukum, sehingga unsur kelalaian (culpa) tidak dapat memenuhi unsur tindak pidana penggelapan menurut Kitab Undang-Undang Hukum Pidana.
